भारत में प्रसारण से संबंधित समिति तथा आयोग : एक चर्चा (भाग -2)
पहला प्रेस आयोग (1952-54)
23सितंबर 1952 को सूचना व प्रसारण मन्त्रालय ने पहले प्रेस आयोग की स्थापना की । जष्टिस जेएस  राजध्यक्ष इसके अध्यक्ष बनाए गए ।
आयोग के सूझाव
- प्रेस की स्वतंत्रता की रक्षा करने के साथ पत्रकारित के उच्च मान को बनाया रखा जाए । प्रेस काउंसिल की स्थापना हो । इसको स्वीकार कर लिया गया और 4जुलाई 1966 को प्रेस काउंसिल की स्थापना हुई । इसी साल 16 नवंबर से प्रेस काउंसिल ने काम भी करना शुरू कर दिया । इसीलिए हरसाल 16नवंबर को राष्ट्रीय प्रेस दिवस के रूप में मनाया जाता है ।
- रजिस्ट्रार आफ न्यूज पेपर आफ इंडिया (आरएनआई) की नियुक्ति हो ।  इस सूझाव को भी ग्रहण कर लिया गया तथा जुलाई 1956 को आरएनआई की नियुक्ति होने लगी ।
- सरकार और प्रेस के बीच मैत्रीपूर्ण संबंधों की स्थापना ने लिए एक सलाहकार कमेटी का गठन हो । इसे स्वीकार कर लिया गया । 22सितंबर 1962 को एक सलाहकार कमेटी का गठन किया गया. ।
- आयोग के सूझाव के आनुसार  श्रमजीवी पत्रकार अधिनियम को भी स्वीकार कर लिया गया और 1955 में इसे लागू किया गया ।
- न्यूज एंजेसी तथा अखबारों की आर्थिक हालातों की जांच के लिए फेक्ट फाइंडिंग कमेटी की स्थापना के सूझाव पर 14जनवरी 1975 को इसकी स्थापना हुई ।
दूसरा प्रेस आयोग( 1978)
29मई 1978 को भारत सरकार ने दूसरे प्रेस आयोग की स्थापना की । जष्टिस पीके गोस्वामी इसके अध्यक्ष बनाए गए हालांकि 14जनवरी 1980 को नई सरकार क्षमता में आने के बाद गोस्वामी और उनकी टीम ने अपने पदों से इस्तीफा दे दिया । जष्टिस केके मैथ्यू की अध्यक्षता में 21 अप्रैल 1980 को फिर से प्रेस आयोग की स्थापना हुई ।
आयोग के सूझाव
- सरकार और प्रेस के बीच मैत्रीपूर्ण संबंधों की स्थापना के लिए कोशिश की जाए ।
- छोटे तथा मध्यम  अखबारों के विकाश के लिए न्यूज पेपर डेवलापमेंट कमिशन की स्थापना होनी चाहिए ।
- अखबार उद्योग व्यावसायिक हित हेतु स्थापित उद्योगों से अलग हो ।
-अखबारों तथा पत्रिकाओं में किसी भी तरह की भविष्यवाणी प्रकाशित न हो ।
-पत्र सूचना कार्यालय का पुनर्गठन हो ।

अदालत की अवमानना; एक अंतर्दृष्टि चर्चा
बीते अगस्त में आपने नौसेना अधिकारी के. एम नानाबटी की जिंदगी पर आधिरत फिल्म रुस्तम जरूर देखी होगी । उसमें दिखाए गए कोर्ट के दृश्यों में जज एक पत्रिका के संपादक को पहले चेतावनी और फिर चेतावनी न मानने पर सजा सुनाते नजर आते हैं । इन दृश्यों की प्रस्तुतिकरण ने आपको हंसाया भी जरूर होगा लेकिन यह एक गंभीर अपराध की श्रेणी में आता है , जिसे अदालती अवमानना कहते हैं । सर्वप्रथम सन् 1926 में न्यायालय की अवमानना का आधिनियम बना था । 26बर्ष बाद 1952 में अदालत की अवमानना संबन्धी नया अधिनियम बना. इस अधिनियम में अवमानना की कोई सुनिर्धारित परिभाषा नहीं दी गई थी । सन् 1961 में गठित सान्याल समिति ने अवमानना अधिनियम पर एक रिपोर्ट पेश की । इस रिपोर्ट और अवमानना अधिनियम पर प्रस्तावित नये दृष्टिकोण को ध्यान में रखते हुए सन् 1971में एक नया न्यायालय अवमानना अधिनियम पारित किया गया, जो 24दिसंबर, 1975 में लागू हुआ ।

अवमानना की परिभाषा
1- किसी न्यायाधीश या जज के खिलाफ निन्दात्मक या विद्वेषपूर्ण वक्तव्य अथवा प्रकाशन द्वारा उसे पद की गरिमा को अयोग्य कहना या लांछन लगाना या उसके पदीय गौरव के खिलाफ आघात करना, या किसी न्यायालय के फैसले खिलाफ निन्दात्मक या विद्वेषपूर्ण वक्तव्य देना अथवा प्रकाशित करना
2- न्यायालय में विचाराधीन मामले के बारे में जनता के मन में भ्रम या पूर्वाग्रह से प्रेरित प्रकाशन
3- न्यायालय में किसी विचाराधीन मामले में जज, पक्षकार, साक्षी पर आक्षेप अथवा उनपर प्रभाव डालने का प्रयत्न करना
4- किसी प्रकाशन के कारण न्यायलय के प्रशासन में हस्तक्षेप या बाधा खड़ी करना
अवमानना के प्रकार
अदालती अवमानना दो प्रकार हो सकते हैं
सिविल
फौजदारी
पहली अवमानना का संबंध किसी निर्णय या निर्देश की अवमानना से है । दूसरी अवमानना का अर्थ लिखे या बोले गए शब्द या संकेत कार्य से है , जो किसी न्यायालय के अधिकार और प्रतिष्ठा को ठेस पहुंचाता है या जिसमें ठेस पहुंचाने की प्रवृति होती है ।
यहां एक बात याद रखने लायक है कि किसी अदालती कार्यवाही की सही और संतुलित रिपोर्ट के लिए किसी व्यक्ति को न्यायालय की अवमानना का दोषी नहीं ठहराया जा सकता है । न्यायालय के निर्णय के खिलाफ सैद्धांतिक आधार पर संतुलित एवं वेवकपरक टिप्पणी के लिए भी किसी व्यक्ति को न्यायालय की अवमानना के लिए दोषी नहीं ठहराया जा सकता ।
अवमानना के लिए सजा
अदालत अवमानना के लिए छह महीने का साधारण कारावास तथा दो हजार रुपये का जुर्माना लगाया जा सकता है । या किसी व्यक्ति को दोनों ही सजा सुनाई जा सकती है । अदालत के समक्ष संतोषप्रद क्षमायाचना की स्थिति में अभियुक्त से सजा से मुक्त किया जा सकता है ।
सजा देने का अधिकार
उच्चतम न्यायालय या उच्च न्यायालय की अवमानना के लिए न्यायालय को स्वयं उस मामले की सुनवाई करने का तथा सजा देने का आधिकार है । फौजदारी अवमानना के लिए सर्वोच्च न्यायलय या उच्च न्यायालय स्वयं कार्यवाही करने का अधिकारी है , या एेसी कार्यवाही के लिए महाधिवक्ता या महाधिवक्ता द्वारा अधिकृत व्यक्ति के आवेदन की अपेक्षा होती है । अवमानना की तिथि से एक वर्ष के भीतर अवमानना के विषय के कार्यवाही शुरू करने की अवधि है । ( आधार- विधि पत्रकारिता: चिंता और चुनौती, लेखक-पवन चौधरी मनमौजी)

“Defamation” is the generic name for the torts of slander and libel. Defamation is to protect the “Freedom of speech and expression” and thus ability of the press to investigate and bringing people’s attention towards malpractices and inflated stories. It strikes a balance between the need to protect reputation and the general right of freedom and speech.

Section 499 of Indian Penal Code describes defamation. Defamation when done through spoken words, gestures, form of rumors and inflated stories is termed as Slander. Defamation when takes place through written ways is known as Libel.  Defamation in India is covered by both the criminal law and the civil law.

There are exceptions also when defamation is not registered.
§   Defamation will not take place, when whenever something is communicated for public welfare and public benefit.

§   It is not defamation to express views about any government official in regard of his discharge of his public duties.

§       It is not defamation to publish true or substantial report of a court proceeding.

§     It is not defamation to express views in good faith about the merits of any case, civil or criminal which has been decided by court (Supreme Court of India).

§      It is not defamation if a person conveys caution to one person against the other, intended for the good of a person to whom it is conveyed or for public good.

 Various punishments for the criminal offence of defamation as described by the Indian Penal Code are as follows:

 Section 500: This section says that whoever defames another person will simply serve a term of two years or with fine or with both.

Section 501: Whoever will engrave or print matter which is defamatory for another person will be punished with an imprisonment of two years or with fine or with both.

 Section 502: Whoever will sells or offers for sale any printed or engraved material containing defamatory matter will be punished with an imprisonment of two years or with fine or with both.

 In civil law, the amount of damages to the reputation of a person differs from case to case and it is to be determined by the judge. (Source: Media Law and Ethics by M Neelamalar)

Understanding Freedom of Speech and Expression

“People demand freedom of speech as a compensation for the freedom of thought which they seldom use.”


“Freedom” is a very important term for all of us and we Indians are being awarded with this right by our Constitution framers .Our visionary Constitution framers had actually imagined that the people of this democracy really need the gift of freedom and liberty. While drafting the Constitution they observed the feature of American Constitution (Bill of Rights) and took inspiration from it and awarded us with all major freedom under article 12-35.They ensured that every realm of the society gets covered under this one umbrella and this country rejoices every bit of it.

A very important freedom that is being awarded in this list is “Freedom of Speech and Expression” under article19 (1)(a). Freedom of speech and expression plays a vital role in every individual’s life as we cannot imagine our existence without it. We Indians struggled for our freedom of expression since British era, they suppressed us by imposing various press regulatory acts .Right from press regulations)(1799) to the gagging act(1857) and then to Vernacular Press Act(1878) but we continued for our struggle for freedom.

Article 19(1)(a) explains that every individual has a right to express himself and can have his own opinions of thought. They can support any opinion, any belief of their own choice and Constitution gives them this right but at the same time Constitution mentions about Article 19(2) which states that freedom also has restrictions on it. Reasonable restrictions can be imposed on the grounds of sovereignty , integrity, security of the state, friendly relations with foreign states, public order, decency or morality, contempt of court,defamation and incitement to an offence.(source:Indian Polity by M Laxmikanth).
